I saw Fox on [the F word Networks'] O'Reilly Factor the other night pumping his new book. How refreshing it was to see two complete idiots bantering on the TV for a change. Seriously, I feel that Bush and Fox both should STFU... on immigration issues affecting The United States. Fox shouldn't have an opinion about what we should be/shouldn't be doing behind our international borders. Why should he be be in a position to dictate his opinion, we'd be foolish to close our southern borders... when he (along with his predecessors,) have been unwilling to do something for their own Countrys people and or its ecconomic growth and development. Instead of fixing the problems in his own country... he's added to our problems by encouraging illegal immigration.

How ironic the U.S Supreme Court is getting involved now - because the Bush Administration is literally strong arming the State of Texas into vacating this mans death sentence and forcing Texas to re-try him (it would take the death penalty off the table... See Double Jeopardy.) Bush is a major hypocrite -- he neither respects the World Court, or saw anything wrong with his executing 149 immate scumbags while he was the Govenor of Texas... whats the difference now??

Unfortunately. the President was correct. The USA and Mexico are covered under the Vienna Convention on Consular Relations (1963) - a treaty. All foreign nationals of a Vienna Convention country detained in another Vienna Convention country's jails are required to be notified in writing by the agency that has custody that they are entitled to contact their country's embassy or foreign counsul and receive them as a visitor with privacy rights similar to attorney-client privilege (the visitation cannot be monitored on audio-video as can normal visitations in jails/prisons). The agency holding the detainee is to treat the foreign consular officers with utmost courtesy as if that person was the president of that country (they are that person's direct representative in this country).

Depending on what country they are from notification of the embassy or foreign counsul is at the will of the detainee or mandatory, even against the wishes of the detainee, upon the agency that has physical custody. All of this is required to be in writing and in a language that the detainee understands. If they can't read an interpreter must be called in to assist with the notification.

I've run up against this situation many times and have even had to contact the State Department's 24-hr DC hotline to talk to the Officer-of-the-Day for assistance and advice. I "wrote the manual" on the subject and taught the subject at the academy.

It's a international treaty. If it's ignored US citizens abroad can and do suffer the consequences if they find themselves in an "offended" country's jail. Every law enforcement agency in the country; federal, state, county and city; were to have instituted an on-going training program and had in place protocols to assure that the Convention was being followed by June of 2000. The process of notification should be SOP by now. If they Fox Uniformed the situation they probably chose the wrong treaty to violate and definitely chose the wrong death penalty case to FUBAR.

Once in a while President Bush really does something right - even if he still pisses off the Pope - because it is right.

Mexico is so aggressive in these cases because Texas has a death penalty but the death penalty is unconstitutional under Mexican law. Mexico does not have a deportation treaty with us that allows them to deport a Mexican citizen to the US for prosecution if the death penalty is still on the table. Mexico, under their constitution, can only deport a potential capital offender if the death penalty has been waived by the prosecution and approved by the court that will be hearing the case.

In this case I'm sure that they had to dig deep to discover that the notification was not made because their citizen was facing the death penalty and deportation to the US from Mexico was not an issue because we had physical custody.

As much as I hate G W Bush... Thanks for the clarification about the Vienna Treaty Darby.Is a doctrine I certainly wasn't familiar with. I still find it perplexing he'll support this treaty, but he won't accept anyone of our people being indicted and tried for "war crimes " committed in foriegn lands by the same Court. In Fact, from all accounts I've read up to now, hes modified a portion of the Geneva convention which affectively pardons everything He Cheney and Rumsfeld did by going into Iraq. None of them can ever be charged with a crime, or brought to justice for some of the attrocities they've committed in the name of "the war on terror".
